Dump-The-Pump Video Contest

 

Contest Rules

By submitting a video, you agree to abide by all of the contest rules and regulations.

 

No purchase is necessary to enter or win.  This offer is subject to all federal, state, and local laws and regulations and is null and void wherever prohibited.

 

The contest begins on June 18, 2009 and ends on September 18, 2009.  Entries not received by 11:59 p.m., Eastern time. APTA is not responsible for any submissions that may be lost, late, misdirected, or incompletely received for any reason whatsoever.  All references to APTA in these rules and regulations shall be deemed to include the American Public Transportation Association, its officers, employees, directors, members, agents, judges, or contractors (including but not limited to GMMB) whether individually or collectively. 

 

By submitting a video, you represent and warrant that your submission is your original work, that it has not been copied from the work or works of others, and that it does not violate the rights of any other person or entity.  You agree to indemnify, defend, and hold harmless against all claims or litigation of any nature arising from or based in your submission or APTA’s subsequent use of your submission.  You agree to release and discharge from any and all liability in connection with the contest including, without limitation, legal claims, costs, injuries, losses or damage, demands, or actions of any kind.

 

You agree that all submissions become the exclusive property of APTA and will not be acknowledged or returned in any form.  APTA or its assigns may use all or portions of the submission in any manner, commercial or otherwise, in any and all media now known or hereinafter devised in perpetuity.  By submitting a video, you and anyone who may otherwise have any rights in the submission agree to relinquish those rights entirely.

By submitting a video, you certify that all identifiable persons appearing in the video have consented to the use of their voice and or likeness and that, upon demand of APTA, you will deliver completed release forms, in the form below, from any and all such identifiable persons.  You further agree that failure to return release forms to the satisfaction of APTA within 7 days of APTA’s request for such forms shall disqualify you for any prize.

 

I ______________, certify that it is my likeness and/or voice that appears in a video submitted by ________ to the _______________ contest.  For valuable consideration acknowledged as received, I irrevocably grant the right to use such likeness or voice to the American Public Transportation Association (APTA) in whole or in part, altered in any manner deemed fit by APTA, and in any manner whatsoever, without limitation or further compensation.  I also agree that APTA may sell, assign, or license use of such likeness or voice in APTA’s sole discretion without additional compensation.

 

You understand and agree that APTA does not condone unlawful, immoral, or dangerous conduct of any nature and, as such, reserves the right, in its sole discretion, to reject any submission without notice if it deems such video to contain or promote unlawful, immoral, or dangerous conduct, or for other good cause as determined within APTA’s sole discretion, and that APTA will not be responsible for any injury, death, or damages related in any way to creation or submission of any video.  You also agree that APTA is not responsible for any costs you may incur in creating or submitting your video.

 

You agree that winners will be determined by APTA and its judges in their sole discretion and their decisions are final.  You agree to waive, to the greatest extent allowable under law, any and all rights you may otherwise have to judicial or other recourse in relation to any aspect of this contest.

 

You agree that, if selected as a winner, you are solely responsible for any and all taxes payable to any government or authority.

 

You understand and agree that APTA may substitute, in its sole discretion, a monetary prize of approximately equal or greater value for any prize awarded.  Values assigned to transit pass prizes shall be determined with reference to the community where the contestant resides, as determined by APTA.

 

The contest is open only to legal US residents who have video uploading capabilities as of June 18, 2009. All applicable federal, state and local laws and regulations apply. Void where prohibited. Employees of APTA and GMMB, as well as their immediate families are not eligible.

 

Winners will be notified before October 13, 2009.

 

The following prizes will be awarded.

 

  • $25 VISA Cash Card – The first 25 qualifying Dump the Pump video submissions as determined by APTA will receive by mail a $25 VISA cash card for their video submission.  Only one $25 VISA cash card per person.  Additional individual entries are not eligible for cash card promotion.

     

  • First Prize - Twelve month's worth of transit (equivalent to the monthly pass rate charged by the transit system in the winner's home city multiplied by 12).  Prize not to exceed $1,900.  And an iPod touch.

     

  • Second Prize - Six month's worth of transit (equivalent to the monthly pass rate charged by the transit system in the winner's home city multiplied by 6). Prize not to exceed $936.

     

  • Third Prize - Three month's worth of transit (equivalent to the monthly pass rate charged by the transit system in the winner's home city multiplied by 3). Prize not to exceed $468.
